Acceptance of these Terms
These Terms of Use (“Terms”) are a binding agreement between you and Monday Q Info 2 (“Monday Q Info,” “we,” “us,” or “our”) governing mondayq.com and related services, content, memberships, community features, contests, emails, and applications that link to these Terms (collectively, the “Service”).
By accessing or using the Service, creating an account, or purchasing a membership, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. Additional terms may apply to a specific feature or promotion; if they conflict with these Terms, the feature-specific terms control for that feature.
Eligibility and accounts
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf. You must be an adult with legal capacity to make purchases, give paid memberships, or enter any prize contest.
Provide accurate, current information and keep access to your email account secure. You are responsible for activity under your account and must promptly tell us about suspected unauthorized use. Accounts are personal, may not be sold or transferred, and may not impersonate another person or organization.
Memberships, billing, and cancellation
Recurring memberships
Paid memberships automatically renew for the billing period shown at checkout—such as monthly or annually—until canceled. By subscribing, you authorize us and Stripe to charge the displayed price, applicable taxes, and any clearly disclosed future renewal price to your payment method on each renewal date.
Cancellation
You may cancel through the billing portal available in your account or by contacting help@mondayq.com. Cancellation stops future renewals and normally takes effect at the end of the paid billing period. Deleting an app, abandoning an account, or stopping use does not cancel a membership.
Refunds, changes, and failed payments
Except where required by law or expressly stated at purchase, payments are nonrefundable and we do not provide prorated credits for unused time. We may change prices or plan features prospectively with legally required notice. If a payment fails, we may retry it, ask you to update payment details, or suspend paid access. Gift memberships are one-time purchases and are subject to the terms shown during checkout.
Service and member content
The Service includes reporting, commentary, podcasts, audio, calendars, tournament information, scores, leaderboards, community discussions, and member-only features. Available features may differ by plan and may change as the Service evolves.
A membership grants a limited, personal, nonexclusive, nontransferable, revocable right to access the included content for private, noncommercial use. You may not share credentials, bypass access controls, scrape or systematically download the Service, republish paid content, or use our content or data to train models or build a competing product without written permission.
Community conduct
When using comments, the Clubhouse, direct messages, profiles, or other interactive features, you may not:
- harass, threaten, stalk, exploit, or discriminate against others;
- post unlawful, defamatory, fraudulent, sexually exploitative, or privacy-invasive material;
- share another person’s sensitive or private information without permission;
- spam, manipulate engagement, solicit fraudulently, or distribute malware;
- impersonate others or misrepresent an affiliation, endorsement, score, or identity;
- interfere with security, rate limits, moderation, data integrity, or other users’ access;
- use automated means to create accounts, post, enter contests, or extract information without permission.
We may investigate reports and remove, restrict, preserve, or disclose content when reasonably necessary to operate and protect the Service. Moderation decisions involve judgment, and we are not obligated to monitor every interaction.
Your content and license to us
You retain ownership of content you submit. You represent that you have the rights needed to submit it and that doing so does not violate law or another person’s rights.
You grant Monday Q Info a worldwide, nonexclusive, royalty-free, sublicensable license to host, store, reproduce, adapt for formatting and accessibility, publish, display, distribute, and otherwise use your content to operate, secure, improve, and promote the Service. This license ends when the content is deleted from active systems, except for reasonable backup periods, content shared by others, and copies we must retain for legal, safety, moderation, or record-integrity purposes.
Feedback and product suggestions may be used without restriction or compensation, but we will not publicly attribute private feedback to you without permission.
Direct messages and moderation access
Direct messages are not end-to-end encrypted. Although they are intended for the participants, authorized personnel may access or preserve them when reasonably necessary for support, safety, moderation, security, legal compliance, or enforcement of these Terms.
Do not use the Service for emergencies or send highly sensitive information through community features. Blocking, reporting, and notification tools may not prevent every unwanted interaction.
The Qualifier and promotions
The Qualifier is a members-only skill competition. Prize-bearing contests are governed by the Official Rules and any contest-specific details displayed before entry. Eligibility, entry periods, prizes, scoring, and winner verification requirements apply in addition to these Terms.
The Qualifier is for entertainment and community participation. It is not sports betting, a wagering service, or an official tournament product. We may correct data errors, void a contest, or adjust scoring as permitted by the Official Rules.
Intellectual property
The Service, including its reporting, text, audio, graphics, designs, logos, software, databases, selection and arrangement, and other original material, is owned by Monday Q Info or its licensors and protected by intellectual-property laws. Third-party names, marks, tournament information, and content remain the property of their respective owners. No license is granted except the limited access right expressly stated in these Terms.
Editorial and results accuracy
We work to provide timely, accurate reporting, schedules, fields, scores, and leaderboards, but source data can be delayed, incomplete, corrected, or unavailable. Unless expressly identified otherwise, Monday Q Info is not the official scoring authority or tournament organizer.
Do not rely on the Service for wagering, financial decisions, professional advice, emergency information, or official eligibility and entry deadlines. Confirm important information with the tournament, tour, governing body, or other primary source.
Third-party services and links
The Service may link to, embed, or interoperate with services such as Stripe, Instagram, X, podcast platforms, calendar providers, and tournament sites. We do not control their content, availability, security, or privacy practices. Your use of a third-party service is governed by its own terms and policies, and a link does not imply endorsement.
Suspension and termination
You may stop using the Service at any time, subject to the separate cancellation requirements for recurring memberships. We may warn, restrict, suspend, or terminate access when we reasonably believe you violated these Terms, created risk or legal exposure, failed to pay, abused other users, manipulated a contest, or threatened the Service’s security or integrity.
Provisions that by their nature should survive termination—including ownership, licenses already granted, disclaimers, liability limits, indemnity, dispute terms, and payment obligations—will survive.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” MONDAY Q INFO DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT CONTENT OR RESULTS WILL ALWAYS BE COMPLETE OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.
Limitation of liability and indemnity
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONDAY Q INFO AND ITS OWNERS, PERSONNEL, CONTRIBUTORS, AFFILIATES, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS OR DATA, LOSS OF GOODWILL, OR SUBSTITUTE SERVICES ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID MONDAY Q INFO DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY WHERE PROHIBITED BY LAW.
To the extent permitted by law, you will defend, indemnify, and hold harmless Monday Q Info and its personnel from third-party claims, damages, and reasonable expenses arising from your content, your unlawful or unauthorized use of the Service, or your material violation of these Terms or another person’s rights.
Governing law and individual arbitration
Michigan law and informal resolution
Michigan law governs these Terms, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration provisions. Before filing arbitration, the claimant must send a written notice describing the dispute, relevant account, requested relief, and supporting facts to help@mondayq.com. The parties will attempt in good faith to resolve the dispute for 60 days.
Binding individual arbitration
Except for eligible individual claims in small-claims court and requests for temporary injunctive relief concerning security or intellectual property, any unresolved dispute arising from these Terms or the Service will be decided by binding individual arbitration administered by the American Arbitration Association (AAA) under its then-current Consumer Arbitration Rules. The arbitration may occur by video, telephone, documents, or at a reasonably convenient location. Fees will be allocated under the AAA rules and applicable law.
NO CLASS OR REPRESENTATIVE ACTIONS. You and Monday Q Info may bring claims only in an individual capacity, not as a plaintiff or class member in a class, collective, consolidated, mass, or representative proceeding. Unless both sides agree, the arbitrator may not combine claims or preside over a representative proceeding. You and Monday Q Info waive a jury trial for claims subject to arbitration.
Thirty-day opt-out
You may opt out of arbitration by emailing help@mondayq.com within 30 days after first becoming bound by this version of the Terms. Use the subject “Arbitration Opt-Out” and include your full name, account email, and a clear statement that you opt out. Opting out will not affect other Terms or your ability to use the Service.
Court proceedings
Claims properly excluded from arbitration must be brought in a state or federal court with jurisdiction in Michigan, and each party consents to that court’s jurisdiction, except where applicable consumer law requires otherwise.
Changes and general terms
We may update these Terms to reflect changes in the Service, law, or business practices. We will post the revised Terms with a new effective date and provide additional notice when legally required. Continued use after the effective date constitutes acceptance of the revised Terms.
If a provision is unenforceable, it will be modified to the minimum extent necessary and the rest will remain effective, except that unenforceability of the individual-action requirement will be handled as required by applicable law. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. These Terms and incorporated policies are the entire agreement about the Service.
